Bowling Green Trial Summary
David Thompson and Hayley Abbott successfully defended an emergency medicine physician in a medical negligence case tried in Warren Circuit Court (Bowling Green). The patient presented to the emergency department with a right retroperitoneal hematoma following a kidney biopsy that had been performed by the patient’s nephrologist. Plaintiff alleged that the patient sustained a puncture wound to his renal artery during the kidney biopsy and that the emergency medicine physician failed to promptly intervene and manage the hematoma. The patient ultimately died secondary to the retroperitoneal hematoma. We defended that the emergency medicine physician took appropriate interventions to treat the patient, including consulting the patient’s nephrologist. The Plaintiffs sought over $20 million dollars in damages. The Warren County jury returned a unanimous defense verdict after brief deliberations.
