Bowling Green Trial Summary

David Thompson and Hayley Abbott successfully defended an emergency medicine physician in a medical negligence case tried in Warren Circuit Court (Bowling Green). The patient presented to the emergency department with a right retroperitoneal hematoma following a kidney biopsy that had been performed by the patient’s nephrologist. Plaintiff alleged that the patient sustained a puncture wound to his renal artery during the kidney biopsy and that the emergency medicine physician failed to promptly intervene and manage the hematoma. The patient ultimately died secondary to the retroperitoneal hematoma. We defended that the emergency medicine physician took appropriate interventions to treat the patient, including consulting the patient’s nephrologist. The Plaintiffs sought over $20 million dollars in damages. The Warren County jury returned a unanimous defense verdict after brief deliberations.

Hospital Client in Significant Medical Malpractice Claim

Susan Phillips and David Thompson received a defense verdict for their hospital client in a significant medical malpractice claim arising out of the neurological impairment of a newborn. The Plaintiffs contended that their daughter suffered neurological impairment, which resulted in profound cerebral palsy, during labor and delivery. The Plaintiffs claimed the nursing staff was negligent in failing to identify the critical nature of the baby’s status, and failing to contact the physicians to ensure their timely arrival at the hospital. Ms. Phillips and Mr. Thompson presented two leading authorities in neonatology and nursing care as expert witnesses, both of whom strongly defended the care of the nursing staff and supported the defense theory that the injury occurred prior to the Plaintiffs’ presentation to the hospital. After four and one-half weeks of trial, the jury deliberated for a little over an hour before returning a unanimous defense verdict in favor of the hospital.

PPOA is excited to announce that David Thompson and Tricia Le Meur have been named partners of the firm. David joined PPOA in 2008 after practicing for seven years in Washington DC and Northern Virginia. During his time at the firm, David has successfully defended physicians, hospitals, as well as other professionals and entities in malpractice trials. Tricia has practiced with PPOA since earning her Juris Doctor in 2001. Since then, she has successfully represented defendants in a variety of professional and liability lawsuits.
